Terms & Conditions
In using Pixi Services, you are deemed to have read and agreed to the following terms and conditions.
1. Terminology
The following terminology applies to these Terms and Conditions, Privacy Statement, Disclaimer Notice, and any or all Agreements:
“Client”, “You”, “Your”: refers to you, the person accessing this website and accepting the Pixi’s terms and conditions.
“Pixi”, “Ourselves”, “We”, “Us”: refers to Pixi Ltd.
“Party”, “Parties”: refers to both the Client and ourselves, or either the Client or ourselves.
All terms refer to the offer, acceptance, and consideration of payment necessary to undertake the process of our assistance to the Client in the most appropriate manner, whether by formal meetings of a fixed duration or any other means, for the express purpose of meeting the Client’s needs in respect of the Company’s stated services/products, in accordance with prevailing English Law.
Any use of the above terminology or other words in the singular, plural, capitalisation, and/or he/she/they, are taken as interchangeable and therefore refer to the same.
2. Privacy Statement
We are committed to protecting your privacy. Authorized employees and/or contractors within the company, on a need-to-know basis, only use any information collected from individual customers. We constantly review our systems and data to ensure the best possible service to our customers.
3. Confidentiality
We are registered under the Data Protection Act 1998. Any information concerning the Client and their respective Client Records will be kept confidential. Client records are regarded as confidential and will not be divulged to any third party, other than our contractors if legally required to do so by the appropriate authorities.
Clients have the right to request sight of, and copies of, any and all Client Records we keep, provided reasonable notice is given. Clients are requested to retain copies of any literature issued in relation to the provision of our services. Where appropriate, we shall issue Clients with written information, handouts, or copies of records as part of an agreed contract for the benefit of both parties. All documents remain stored in a Google Doc folder, and clients may have access at any time.
We will not sell, share, or rent your personal information to any third party or use your email address for unsolicited mail. Any emails sent by this Company will only be in connection with the provision of agreed services and products.
4. Payment
Direct Debit, Automatic Payment, and Cheque are all acceptable methods of payment.

Payment is due in full within seven days of the invoice date unless other arrangements have been agreed.

Monthly services are due on the 7th of the following month, or another date as agreed. For example, if service is carried out in March 2025, the payment will be due on April 7th, 2025.

Money that remains outstanding by the due date will incur late payment interest at the rate of 2% base rate on the outstanding balance until paid in full. A 2% late penalty will be added monthly until payment is made in full.

We reserve the right to seek recovery of any monies unpaid sixty days from the invoice date via collection agencies and/or the Small Claims Court. In such circumstances, you shall be liable for any additional administrative and/or court costs.

We reserve the right to terminate the arrangement if late payments continue. If agreed, we shall insist on future cash, direct debit, or credit card transactions only. All work, transactions, and agreements will cease immediately until all outstanding monies are recovered in full.
5. Cancellation Policy
We have fixed contracts in place for 6 months for all services. This timeframe allows sufficient work upfront and enables us to show real results.
After any contract finishes, we roll over into a 30-day cancellation notice period.

Notification for cancellation must be received in writing via email. Pixi will confirm the cancellation date via email.

A full 30 days’ notice is required. For example, if you cancel mid-month, we will carry out the current month’s work and continue work for the following month to allow a full 30-day notice period. (It is recommended to cancel close to the end of the month.)
6. Termination of Agreements and Refunds Policy
Both the Client and Pixi Ltd have the right to terminate any Services Agreement for any reason, including ending services already underway.

No refunds shall be offered where a Service has begun and is underway.

Any monies paid for unused services shall be refunded.
7. Log Files
We use IP addresses to analyse trends, administer the site, track user movement, and gather broad demographic information for aggregate use. IP addresses are not linked to personally identifiable information.
For systems administration, detecting usage patterns, and troubleshooting purposes, our web servers automatically log standard access information including browser type, access times/open mail, URL requested, and referral URL. This information is not shared with third parties and is used only within the Company on a need-to-know basis. Any individually identifiable information will never be used differently than stated without your explicit permission.
8. Links from This Website
We do not monitor or review the content of third-party websites linked from this website. Opinions expressed or material on such websites are not necessarily shared or endorsed by us.

Users should evaluate the security and trustworthiness of any other site accessed through this site before disclosing personal information.

11. Force Majeure
Neither party shall be liable for any failure to perform obligations due to events beyond their control, including but not limited to Acts of God, terrorism, war, political insurgence, insurrection, riot, civil unrest, acts of civil or military authority, uprisings, earthquakes, floods, or any other natural or man-made events.
Any affected party shall inform the other party immediately and use all reasonable endeavours to comply with the terms of any Agreement.
12. Waiver
Failure of either Party to insist upon strict performance or to exercise any right or remedy does not constitute a waiver of that provision. No waiver is effective unless expressly stated and signed by both Parties.
13. General
The laws of New Zealand govern these terms and conditions. By accessing this website and using our services, you consent to these terms and the exclusive jurisdiction of the New Zealand courts.

If any term is deemed invalid or unenforceable, it will be severed and remaining terms continue to apply.

These Terms and Conditions shall not be amended, modified, varied, or supplemented except in writing and signed by duly authorised representatives.
14. Notification of Changes
The Company reserves the right to change these conditions from time to time. Your continued use of the site signifies acceptance of any adjustment.

These Terms and Conditions form part of the Agreement between the Client and Pixi Ltd. Accessing this website or undertaking our services indicates your understanding, agreement, and acceptance. Your statutory Consumer Rights are unaffected.
